It is well-known that the ACCC investigates criminal cartel conduct which affects Australian businesses, given the record fines recently imposed on WWO, K-Line and Nippon. However, it is less understood how the ACCC wields misuse of market power provisions against providers of maritime services, such as port operators and pilotage service providers.
